Wow! SCOTUS has a pulse!
“The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration and scope,” [Chief Justice John] Roberts wrote. But the Trump administration “points to no statute” in which Congress has previously said that the language in IEEPA [the International Emergency Economic Powers Act] could apply to tariffs, he added. As such, “we hold that IEEPA does not authorize the president to impose tariffs,” Roberts wrote.
A H/T to my friend, Ilya Somin, for his superb work on this “enormous usurpation of legislative power by the executive and an abuse of emergency power” by the Trump administration.
For my own discussion of the disastrous Trump tariff regime, see here.
